Terms & Conditions
By using RapidEx's services, you (the "Shipper") agree to these terms and conditions on behalf of yourself, the receiver of the shipment ("Receiver"), and any other party with an interest in the shipment. These terms govern all aspects of the shipment process, including but not limited to pickup, transport, customs clearance, and delivery.
A shipment refers to all documents or parcels traveling under one air waybill. All shipments are transported under a limited liability basis as outlined herein. If greater protection is required, additional insurance may be purchased at an extra cost.
Definitions
To ensure clarity, the following definitions apply throughout this document:
- Shipper: The individual or entity sending the shipment.
- Receiver/Consignee: The individual or entity receiving the shipment.
- Delivery Duty Unpaid (DDU): The Receiver is responsible for paying all applicable customs duties and taxes before delivery.
- Return to Origin (RTO): The process of returning an undeliverable shipment to the Shipper.
- Freight Charges: The cost of transporting the shipment from origin to destination, excluding customs fees and duties.
STANDARD TERMS & CONDITIONS
1. Customs Clearance
By using RapidEx's services, you authorize RapidEx to act on your behalf for customs clearance and related procedures, including but not limited to:
- Completing, correcting, or amending required documentation and product or service codes to comply with local regulations.
- Paying duties and taxes as required by the applicable laws.
- Acting as the Shipper's agent for customs clearance and export control purposes.
- Redirecting shipments to an alternative customs broker if requested.
- Holding shipments pending customs clearance, if required by authorities.
RapidEx is not responsible for delays caused by customs clearance or regulatory authorities. Any additional fees or penalties imposed by customs must be paid by the Shipper or Receiver.
2. Unacceptable Shipments
Shipments will be deemed unacceptable and may be refused, delayed, or returned if they contain:
- Prohibited items such as counterfeit goods, weapons, ammunition, narcotics, human remains, currency, and illegal substances.
- Hazardous materials classified under IATA, ICAO, or other regulatory bodies.
- Items with incorrect or incomplete addresses or inadequate packaging.
- Any items restricted by applicable local or international laws.
RapidEx reserves the right to reject shipments at its discretion and may notify authorities if illegal items are detected.
3. Delivery and Undeliverable Shipments
- Shipments cannot be delivered to P.O. boxes unless explicitly allowed by local regulations.
- If the Receiver cannot be identified, refuses delivery, or fails to pay duties and taxes, the shipment may be returned to the Shipper or disposed of at the Shipper's expense.
- If legal restrictions prevent the return of a shipment, RapidEx may destroy the shipment without liability.
- Shipments will be deemed undeliverable if they are held beyond the allowable period due to non-payment of required fees.
- For all DDU (Delivery Duty Unpaid) shipments, the Receiver is responsible for paying the applicable duties and taxes before receiving the shipment. If the Receiver refuses to pay these charges, the Shipper is liable for return costs or any other fees associated with handling the shipment. Failure to comply within 7 days of shipment arrival may result in disposal, and RapidEx will not be held responsible for any losses incurred.
4. Inspection Rights
RapidEx reserves the right to inspect shipments at its sole discretion for security, regulatory, or customs-related purposes. Such inspections may be conducted without prior notice to the Shipper or Receiver. RapidEx is not liable for delays resulting from such inspections.
5. Liability and Limitation of Damages
- RapidEx's liability is limited to the lower of the declared shipment value or the standard per-kilogram limits as per applicable conventions.
- RapidEx is not liable for indirect losses, lost profits, or consequential damages unless expressly covered by a Money-Back Guarantee (if applicable).
- Liability does not extend to delays, loss, or damages arising from external factors such as weather, customs inspections, or acts of third parties.
6. Shipment Charges, Duties, and Taxes
- Shipment charges are based on the greater of actual or volumetric weight.
- The Shipper or Receiver is responsible for all customs duties, taxes, and additional fees.
- If RapidEx advances any customs duties or taxes, an additional fee may apply.
- Delivery Duty Paid (DDP): The Shipper pre-pays customs duties and taxes, which are added to the shipment cost.
- Delivery Duty Unpaid (DDU): The Receiver must pay applicable duties and taxes before receiving the shipment. Failure to pay may result in the shipment being returned or abandoned at the Receiver's expense.
- Return charges for undelivered shipments: If a shipment needs to be returned due to non-payment of duties or taxes, the Shipper is responsible for return shipping fees. If no action is taken within 7 days of arrival, the shipment may be destroyed per policy.
7. Insurance and Claims
- Additional insurance coverage may be purchased at an extra cost.
- Claims for lost or damaged shipments must be submitted within 7 days of the shipment date.
- The maximum liability per consignment is the Invoice Value + Shipping Charges or $100 (whichever is lower) unless additional insurance has been purchased.
8. Remote Area Surcharges
Shipments to remote locations may incur additional charges. The list of remote areas and applicable charges is available on official courier websites (e.g., SkyNet, FedEx, DHL). These surcharges are the responsibility of the Shipper or Receiver.
9. Return to Origin (RTO) Policy
If a shipment is returned due to incorrect address, non-payment of fees, or Receiver refusal, RTO charges will be billed to the Shipper.
If the required details for delivery are not provided within the specified timeframe, RapidEx may return or destroy the shipment at the Shipper's expense.
Unclaimed shipments will be held for 7 days before being deemed undeliverable and subsequently disposed of. RapidEx will not bear any responsibility for shipments destroyed due to non-payment of return charges.
10. Circumstances Beyond RapidEx's Control
RapidEx is not liable for losses caused by:
- Acts of nature (e.g., floods, earthquakes, storms).
- Acts of government, customs, or third-party interference.
- Electrical or magnetic damage to digital content.
11. Warranties and Indemnities
Shippers must ensure:
- All shipment information is accurate and complete.
- Shipments comply with all applicable laws and regulations.
- Necessary consents are obtained for providing personal data (such as recipient emails or phone numbers).
12. Routing
The Shipper agrees to all routing and diversion, including possible intermediate stopping points.
13. Mandatory Law
- These conditions shall not exclude any liability prohibited by law.
- If any clause contradicts applicable laws, it will be limited to the maximum extent permitted while the rest remains enforceable.
14. Severability
If any provision is found invalid, the rest of the terms and conditions shall remain in full effect.
15. Exclusions for Delays & Indemnification
RapidEx is not responsible for delivery delays resulting from incomplete or inaccurate shipment details provided by the Shipper. The Shipper agrees to indemnify and hold RapidEx harmless from any claims, damages, or liabilities arising due to non-compliance with applicable laws and shipping regulations.
16. Insurance & Liability Coverage
The Shipper may opt for additional insurance coverage at an extra cost. Insurance does not cover delays, confiscation by customs, or damage caused by insufficient or improper packaging. The Shipper acknowledges that liability for loss or damage is limited to the declared value or $100 per consignment (whichever is lower), unless additional insurance is purchased.
17. Acknowledgment & Agreement
By booking a shipment with RapidEx, the Shipper explicitly acknowledges and agrees to:
- The terms outlined in this document.
- The financial responsibility associated with DDU shipments, including duties and taxes payable by the Receiver.
- The 7-day policy for unclaimed shipments, after which disposal may occur with no liability on RapidEx.
18. Data Collection and Use
We collect personal information such as names, email addresses, phone numbers, addresses, national identification numbers (where required), and shipment-related details:
This data is used for:
- Processing shipments and deliveries.
- Customs clearance and compliance.
- Communicating with Shippers and Receivers.
- Customer support and service improvements.
- Marketing communications (only with consent).
19. Data Sharing
We may share your data with third parties such as:
- Logistics and courier partners (e.g., FedEx, DHL).
- Customs and regulatory authorities.
- IT service providers for internal operations.
- Legal entities if required by laws.
- We do not sell or rent your personal information to third parties..
20. Data Protection and Security
We employ industry-standard security measures, including encryption, secure servers, and access control to protect your data. Despite our efforts, no system can be 100% secure. In case of a data breach, we will notify affected users promptly as required by law.

21. User Rights
You have the right to:
- Access the personal data we hold about you.
